Article 1 — Definitions
- Stable Drums: Stable Drums BV, located in Eindhoven, the Netherlands, CoC 12345678.
- Dealer: a reseller authorized by Stable Drums.
- Distributor: Tone Distribution, exclusive distributor of Stable Drums products.
- Customer: the person or entity that buys Stable Drums products through a dealer.
Article 2 — Applicability
These terms apply to all offers, agreements and deliveries by Stable Drums. Deviations are only valid if agreed in writing.
Article 3 — Sales via dealers
Stable Drums products are sold exclusively through authorized dealers. The general terms of the dealer apply to the sale between dealer and end customer.
Article 4 — Product information
We strive to describe products and specifications as accurately as possible. Images are indicative; minor variations in color or finish do not entitle the buyer to cancellation or refund.
Article 5 — Warranty
- All Stable Drums products carry a 5-year factory warranty on manufacturing defects.
- Wear parts on pedals carry a 2-year warranty.
- Warranty claims are handled through the dealer where the product was purchased.
- The purchase invoice serves as proof of warranty.
The warranty is void in case of improper use, modifications by unauthorized parties, accidental damage or normal wear.
Article 6 — Repair and maintenance
Out-of-warranty repairs are performed by the dealer at applicable rates. Parts remain available for at least 10 years after a product is discontinued.
Article 7 — Liability
Stable Drums is not liable for indirect damages, consequential damages or loss of profit. Liability is limited to the purchase value of the relevant product. This limitation does not apply in cases of intent or gross negligence.
Article 8 — Intellectual property
All designs, brands and logos of Stable Drums are protected under intellectual property law. Reproduction without written consent is prohibited.
Article 9 — Dealership
Dealership applications are processed through our distributor Tone Distribution. Stable Drums reserves the right to refuse applications without stating a reason.
Article 10 — Changes
Stable Drums reserves the right to change products, specifications and prices. Products already delivered are not affected.
Article 11 — Applicable law
Dutch law applies to these terms. Disputes will be brought before the competent court in the East Brabant district.
